1. Introduction

Welcome to Gymcierge. These Terms and Conditions ("Terms") govern your access to and use of the Gymcierge website, mobile applications, products, and services (collectively, the "Service") provided by Gymcierge ("we", "us" or "our"), located at gymcierge.com.

By accessing or using the Service, you agree to these Terms. If you do not agree, you may not access or use the Service.

2. Eligibility

You represent and warrant that you are at least the age required in your jurisdiction to use the Service (typically 13+ or 16+ for certain features depending on location).

3. Use of the Service

3.1 Account Registration

To access certain features (e.g., coaching tools, progress tracking, personalised dashboards), you must create an account. You agree to provide accurate information and to maintain the confidentiality of your account credentials.

3.2 Client Accounts

Free Clients can use core workout logging, progress tracking, and personal dashboards at no cost. Certain features (e.g., exercise videos, advanced progress summaries, AI insights) are available only with a Premium Client subscription.

3.3 Coach Accounts

Coaches may subscribe to plans such as Coach Basic, Coach Professional, Coach Unlimited, or equivalent tiers offered on the Site. Subscription plans determine the scope of access, e.g., number of clients managed, AI programme generations, exercise videos, custom branding, etc.

A 90-day free coach trial is available with certain limitations (e.g., limited clients, limited AI generations, no exercise videos) via code JANTRIAL. After the trial period, billing begins in accordance with the plan selected.

4. Subscriptions and Payments

4.1 Billing

Subscription pricing is displayed on the Site and may vary by region (e.g., USD, GBP, EUR). You grant us the right to charge your selected payment method for all fees.

4.2 Free Trial

Free trials are offered at our discretion. Each account may be eligible for only one free trial. Unused features or credits do not carry over.

4.3 Refunds

Unless otherwise required by law, all subscription fees are non-refundable. We may offer prorated refunds or credits at our discretion.

5. Ownership and License

All content, exercise libraries, AI models, training tools, and intellectual property used in or distributed with the Service remain our property or that of our licensors.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service.

6. User Conduct

Users agree not to:

• Misuse the Service
• Attempt to gain unauthorised access
• Upload harmful content
• Infringe others' rights

We reserve the right to suspend or terminate accounts for violations.

8. Disclaimers

The Service is provided "as is". We do not guarantee specific results from exercise programmes.

Profile, exercise, and health data should not be construed as medical advice. Consult a professional for health or medical concerns.

9. Limitation of Liability

To the extent permitted by law, Gymcierge and its affiliates are not liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Service.

10. Governing Law

These Terms are governed by the laws of the jurisdiction where Gymcierge is incorporated. Disputes will be resolved in appropriate courts.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance.
