1. Introduction

These Terms and Conditions govern access to Gymcierge websites, mobile applications, software, payments tooling, and related services provided by Gymcierge.

By accessing or using Gymcierge, you agree to these Terms. If you do not agree, you may not access or use the service.

2. Plans and Commercial Catalog

Public coach subscription tiers are Coach Basic, Coach Professional, and Coach Unlimited. Public gym subscription tiers are Gym Launch, Gym Growth, and Gym Scale.

Legacy internal plans, including grandfathered enterprise records, may remain visible inside Gymcierge administration and billing surfaces, but are not offered as new public checkout options unless Gymcierge explicitly agrees otherwise in writing.

Pricing, feature bullets, platform-fee rates, and public labels may vary by region and are shown on the pricing page.

3. Payments, Stripe Connect, and Platform Fees

Gymcierge uses Stripe and Stripe Connect for subscription billing, memberships, coaching payments, and connected-account payouts. Coaches and gyms that accept member payments or direct client payments may be required to onboard as Stripe connected accounts.

Members always pay the listed price. Stripe payment-processing fees and the applicable Gymcierge platform fee are deducted before payout. Gymcierge does not add a consumer card surcharge at checkout.

Launch offer: 0% Gymcierge platform fees for the first 90 days. GBP sellers keep 0% until day 90 or £5,000 processed; EUR sellers until €5,000 processed; USD sellers until $5,000 processed. EUR and USD caps include a small FX buffer because platform settlement is in GBP.

4. Refunds, Chargebacks, and Payout Responsibility

The coach or gym selling the service remains responsible for the underlying coaching service, gym membership, package delivery, refunds, disputes, and customer support unless Gymcierge explicitly states otherwise for a specific transaction flow.

Stripe may deduct dispute fees, refunds, reversals, or reserves from the connected account or future payouts. Gymcierge may also retain or reverse its platform fee where required for refunds, fraud prevention, or reconciliation.

Connected sellers are responsible for ensuring their products, memberships, subscriptions, and public claims comply with applicable law, consumer rights, tax, and VAT requirements in their jurisdiction.

5. Accounts and Eligibility

You must provide accurate account, legal-entity, and payout information, maintain the confidentiality of your credentials, and use Gymcierge only for lawful fitness, coaching, or gym-business operations.

Gymcierge may suspend or terminate access where required for fraud prevention, legal compliance, payment-network rules, abuse, or non-payment.

6. Acceptable Use

• Do not misuse the service or attempt unauthorised access.
• Do not upload harmful, illegal, or infringing content.
• Do not use Gymcierge to evade payment, tax, consumer-protection, or financial-services obligations.
• Do not misrepresent pricing, fees, membership terms, or refund rights to members or clients.

7. Intellectual Property

Gymcierge and its licensors retain ownership of the software, branding, exercise libraries, templates, and related intellectual property unless explicitly stated otherwise.

Subject to these Terms, Gymcierge grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the service.

8. Privacy and Data

Privacy practices are described in the Privacy Policy. Coaches and gyms remain responsible for handling member and client data lawfully, including where they export or process that data outside Gymcierge.

9. Disclaimers and Liability

Gymcierge is provided "as is" and does not guarantee business results, health outcomes, uninterrupted availability, or payment acceptance in every region or payment method.

To the maximum extent permitted by law, Gymcierge is not liable for indirect, incidental, special, punitive, or consequential damages arising from use of the service.

10. Changes to These Terms

Gymcierge may update these Terms from time to time. Continued use of the service after an update takes effect constitutes acceptance of the revised Terms.
